OMNYA TRAVEL LTD Terms and Conditions

As a Member of Omnya Travel Ltd, you agree to withstand by these Terms and Conditions, and when ordering, or purchasing anything from a supplier of products or services, you agree that these Terms and Conditions shall apply to your order. These Terms and Conditions shall prevail over any other terms and conditions in any form whatsoever.

These terms and conditions govern your use of the Omnya Travel (Website) and any order which you place through the Website from the UK. You should read these terms carefully before you use the Website or purchase our services from the Website. These terms tell you who we are, how you can use the Website, how you can use our services, what to do if there is a problem and other important information.

1. Membership rules

a. All Membership are subject to verification and acceptance by Omnya Travel LTD

b. You agree to ensure you provide correct details when you sign up to Omnya Travel memberships

c. Your Membership is personal to you. You are responsible for ensuring that no one uses your Membership.

d. All reservations made should be for your personal use only. If you wish to appoint somebody to make reservations on your behalf, please provide their information to the Omnya Team

e. The Omnya Travel Membership is only available to person over the age of 18. Any unauthorized or attempted use by persons under the age of 18 will be null and void.


2. Membership fees, cancellations, and renewals

a. Membership fees are communicated on the website prior to payment.

b. You acknowledge that your payment of the Membership Fee constitutes your express request for us to begin to supply you with our services.

c. Your Membership fee is non-refundable.

d. Membership fees are due on acceptance of your Membership and annually thereafter (“Renewal Date”). Membership fees are payable annually only and renewed automatically unless informed otherwise.

e. You authorize Omnya Travel LTD to deduct renewal Membership fees by your nominated payment card. If Omnya Travel LTD does not hold your payment details, you will be contacted directly in order to renew your Membership.

f. Any increase or decrease to the Membership Fees will be notified to all members in advance of their renewal date.

g. If you do not wish to renew Membership you must notify us more than 48 hours prior to your Renewal Date.

h. If, during the course of your current membership, you wish to upgrade your membership to a higher one, the difference in price will be calculated on a pro rata basis automatically via your profile.


3. Using your membership

a. You are only entitled to benefits, once you have been accepted as a Member of Omnya Travel LTD.

b. Omnya Travel LTD reserves the right to withdraw any of these Services and/or to refuse to supply the Services requested.

c. If Omnya Travel LTD is unable to deal with any request, the bookings team will inform you as soon as reasonably practicable.

d. Suppliers are responsible for providing you with the services, products and benefits you select.


4. Dine and Pay, VIP packages, and cancellations

a. All restaurant bookings are non-refundable and non-exchangeable. If you wish to cancel your booking, Omnya Travel LTD, will apply a store credit of the equivalent amount. All restaurants bookings purchased via Dine and Pay are to be used within 3 weeks’ time maximum.

b. Dine and Pay offers daily and weekly restaurants options from you to choose from.

c. Admission of Members and clients to any club premises is at all times at the sole discretion of the club Supplier, and Omnya Travel LTD shall have no liability where a member or client is refused admission.

d. Hotel cancellation policies are in line with those set by the hotels directly.

e. Members and clients are responsible for checking into the hotel themselves. Members and clients are also required to make sure that all of their booking confirmations are correct. Omnya Travel LTD is not liable for any errors made by Members or Clients.

f. Omnya Travel LTD reserves the right to deny restaurant requests from Members and clients, if members or clients repeatedly fail to honor their bookings or continuously violate the cancellation policy.

6. Use of the Website

b. You can register an account with us to help you using our services more quickly. When you create an account, you confirm that:

  1. the details which you provide (e.g. your name) are real and accurate;
  2. you’ll notify us immediately of any changes to your details by updating these details on your online account; and
  3. you won’t impersonate any other person or use any details that you’re not authorised to use.

c. We recommend that you keep your account details safe. You should tell us immediately if you become aware of any unusual or unauthorised activity on your account.

l. You may link to our Website, Twitter, Instagram, Facebook, SnapChat and Pinterest, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. When you’re linking to our website or social media, you may not do so in a way that suggests we’re approving or endorsing you.

m. You must not establish a link to our Website in any website that is not owned by you.

n. Our Website must not be framed on any other site, nor may you create a link to any part of our Website other than the home page.

o. We reserve the right to withdraw linking permission without notice.

  1. if we know or suspect that you’re not following these terms and conditions, we may remove your account or stop your access to the Website;
  2. we can change these terms and conditions from time to time.  We shall try to ensure that any new version of these terms and conditions shall be announced in advance on our Website.  The version that is on the Website will always take precedence over all the other versions of these terms and conditions.  However, the applicable terms and conditions are those accepted by you at the time of placing the order; and
  3. these Website terms and conditions are covered by English law. If you’re not happy with any of these terms, you and Alec Touret agree that any disagreement or dispute will take place in the courts of England and Wales (except if you live in Northern Ireland, you can also go to the courts in Northern Ireland or if you live in Scotland, you can also go to the courts in Scotland).


8. How can I be featured on the Website?

a. If you would like to be featured on the Website:

  1. you need to make sure you meet our requirements which are set out.
  2. you promise us that any content you submit are yours or that you’ve got permission to submit them to us;
  3. you’re happy for us to publicly share your content on the Website and social media channels, and so you’re happy for us to have a right to use, store, copy, distribute your photo and make it available to third parties; and
  4. you tag #OMNYATRAVEL.

b. It is completely in our discretion as to whether we will use any content submitted to us by third parties and we can take down any content at any time. However, before we use any content you submit to us we will always ask your permission before we use it.

d. You confirm that any such contribution does comply with those standards, and you may be liable to us if your contribution doesn’t comply with those standards. This means you will be responsible for any loss or damage we suffer as a result of your contribution doesn’t comply with those standards.


9. How can I buy from the OMNYA TRAVEL WEBSITE?

a. In order to buy any of our services on our Website you need to:

  1. click on any product that you’d like to buy, click the quantity that you’d like to buy and then click “Add To cart”;
  2. click the shopping bag icon at the top of the Website and then click “Checkout” or “PayPal” depending on how you’d like to pay;
  3. the order process will show you our acceptable payment methods;
  4. you’ll be asked to provide your contact, shi and payment information during the order process;
  5. you’ll be shown a breakdown of the product price and any applicable delivery costs; and
  6. you’ll place your order by pressing the “Complete Order” button at the end of the checkout process.

b. We want you to enjoy your Omnya Travel’s Services yourself and so we’re only offering them to you for personal use.

c. We’ll send you an order confirmation email setting out the details of the services you’ve ordered. This e-mail does not mean your order has been accepted.

d. We’ll take payment from you once your order has been placed.

e. There are times when we’re not able to accept your order. This might happen if:

  1. the service you’re looking to buy is unavailable;
  2. we’re not able to take payment from you;
  3. you don’t comply with these terms and conditions of sale;
  4. there is a technological failure and we can’t process your order;
  5. you haven’t provided us with all the information we need to fulfil your order; or
  6. we’ve spotted an error in the price or description of the service.

11. Our responsibility for loss or damage suffered by you

a. If we fail to comply with these terms and conditions of sale, we are responsible for loss or damage you suffer that is a foreseeable or obvious result of us breaking this contract, at the time we accept your order.

b. We only supply the services for personal use. We will not be liable to you in any way for:

  1. any loss of revenue, profit, business or sales that you suffer; or
  2. any losses which are not foreseeable or are not obvious when we accept your order.


12. Finally, some other important terms

a. Nobody else has any rights under these terms and conditions of sale.

b. If either you or we do not enforce any part of these terms and conditions, that party is not prevented from enforcing that part of these terms and conditions at any time.

c. These terms and conditions of sale are covered by English law. If you’re not happy with any of these terms, you and Alec Touret agree that any disagreement or dispute will take place in the courts of England and Wales (except if you live in Northern Ireland, you can also go to the courts in Northern Ireland or if you live in Scotland, you can also go to the courts in Scotland).
